1. Application and purpose
This Privacy Policy applies to the activities of Act Now Sdn. Bhd. (1321403-M) ( ACTnow ) and is to inform you (You/ Your) regarding the use of Your information which is collected during Your use of ACTnow’s smartphone application ( App) on Your smartphone device ( Device ). The App is designed and built to empower users to report problems or defects in community assets and infrastructure requiring repair or attention to local authorities for reporting and repair ( Services ).
ACTnow is committed to protecting the privacy of all its users and this Privacy Policy explains how we use and protect your information. By using our App, website or other online services, You agree and where required you consent to the collection, use and disclosure of Your personal information as set out in this policy.
2. Information we collect
When You download and use our App and/or any other service or application of ACTnow, we may collect usage information and device information as outlined below.
The information ACTnow collects is what You tell ACTnow about Yourself and information about how You use the App and Services, such as personal information You tell ACTnow about Yourself (including Your name, Your phone number and street address) and using the App and location. By using the App and Services, You authorise us to collect your information such as your username, name, email address and any other personal information available on or through your use of the App.
We may also collect information relating to your use of our App and Services and if You contact ACTnow, ACTnow may keep a record of that correspondence. ACTnow may also draw upon this information in order to adapt the Services to your needs, to research the effectiveness of ACTnow’s network and Services, and to develop new tools for the Services. Where possible, Act-Now endeavours to limit ACTnow’s collection of Your personal information.
If You do not provide personal information ACTnow may not be able to provide you with the Services.
3. Location data
You agree and consent to ACTnow’s use of Your location data where applicable. When You use the App and the Service, and send a report, ACTnow receives and records information on its server logs from Your mobile platform, including Your location. ACTnow treats this data as non-personal information, except where ACTnow are required to do otherwise under applicable law.
To best manage information such as location data, You may disable the tracking functionalities on Your Device, although the App and the Services will not operate to their full capacity and if You do not provide the location You will not be able to file a report.
4. Device Information
ACTnow may collect information about your device when you use the App including the unique device identifier, device model, operating system, and MAC address. Additionally, when you use our Service, our server may send small data files known as ‘cookies’ and other similar technologies to your device. A cookie file can contain information, such as a user ID which the website uses to track the pages you have visited. You can refuse all cookies by turning them off in your Device however, our App and Services may not operate to their full capacity without cookies enabled.
5. Minors
The App is not aimed at children under 18 years old and ACTnow do not knowingly collect, use, provide or process in any other form any personal information of children under the age of 18 deliberately.
6. Using and disclosing Your personal information
ACTnow’s purpose in collecting information about You is to provide You with Services that You request and to operate ACTnow’s business efficiently.
ACTnow will use Your personal information for the purpose disclosed at the time of collection, or otherwise as set out in this privacy policy. We will not use your personal information for any other purpose without first seeking your consent, or where authorised or required by law.
The circumstances in which ACTnow may disclose information about You are limited, but may include:

for marketing purposes when You have given Your consent;
to an organisation that is an affiliate of ACTnow Pty Ltd or a partner of ACTnow (including, for example, local authorities to manage the report you have lodged via the App), either in Malaysia or overseas;
when ACTnow believe it necessary to provide You with a service which You have requested, such as contacting You about Your use of the App;
to protect ACTnow rights, property or personal safety or those of another customer or any member of the public; and
in the event that the assets and operations of ACTnow’s business are transferred to another party as a going concern.
ACTnow may also share or disclose Your de-identified information (including where aggregated with other user’s information) or otherwise non-personal information with third parties for industry or statistical analysis.
7. Service providers
Like many businesses, ACTnow uses a range of service providers to help Act-Now maximise the quality and efficiency of ACTnow services and ACTnow business operations. This means that third parties will sometimes have access to personal information held by ACTnow and may use it on ACTnow’s behalf only to the extent that it is reasonably necessary to provide the Services. ACTnow require its service providers to respect the confidentiality of information that they handle on ACTnow’s behalf, and not to keep this information any longer than required for the performance of services to ACTnow or use it for unauthorised purposes.
8. International Use
Please note that information collected by ACTnow may be hosted on computer servers outside of Your home country. Therefore, Your information may be processed and stored in a jurisdiction other than Your home country. As a result, depending on the applicable law, foreign governments, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your information through laws applicable in the relevant jurisdiction. Your use of this site or the App or Services or Your submission of any personal information to ACTnow will constitute Your consent to the transfer of your personal information outside of Your home country, which may provide for different data protection rules than in Your country. However, this does not change any of ACTnow’s commitments to safeguard Your privacy and Your personal information and if ACTnow discloses personal information to a third party outside of Your home country, ACTnow will seek assurances that any information we may provide to them is safeguarded adequately and in accordance with this Privacy Policy and the requirements of applicable privacy laws.
9. You can request access to the information Act-Now keep about You
If at any time You want to know exactly what personal information ACTnow holds about You, You are welcome to request access to Your record. Please contact ACTnow as set out below. ACTnow will endeavour to respond to requests within the time allowed by all applicable privacy laws and will make every effort to respond as accurately and completely as possible following Your request. If at any time You wish to change personal information that is inaccurate or out of date, please let ACTnow know and ACTnow will amend ACTnow records. If You wish to have Your personal information deleted, please let ACTnow know and ACTnow will take all reasonable steps to delete it unless ACTnow need to keep it for legal reasons. If access or corrections cannot be provided, ACTnow will notify You within 30 days, in writing, of the reasons for the refusal.
10. Storage and security of Your personal information
ACTnow endeavours to take all reasonable steps to keep secure any information which ACTnow holds about You, and to keep this information accurate and up to date where possible. Your information is stored on secure servers that are protected in controlled facilities. ACTnow requires ACTnow employees and data processors to respect the confidentiality of any personal information held by ACTnow. Unfortunately no website or Internet transmission is ever completely secure and although we will take steps to protect your personal information, we cannot guarantee that unauthorised access, hacking, data loss or other breaches will never occur.
11. Future changes
ACTnow are committed to providing the best customer experience and will continue to evolve to meet ACTnow’s customer’s needs. Because of this, from time to time, ACTnow policies will be reviewed and may be revised. ACTnow reserve the right to change this Privacy Policy at any time and notify You by posting an updated version of the policy on the ACTnow website. The amended Privacy Policy will apply whether or not ACTnow has given You specific notice of any change and Your continued use of the App or the Services after any change to this Privacy Policy will constitute your acceptance of the change. ACTnow therefore recommends You check ACTnow’s Privacy Policy from time to time.
